Privacy Notice

In this Privacy Notice (“Privacy Notice”), Mozaik Multimedia, Inc. (“we,” “us,” “our,” or “Mozaik”), provide information about how we collect, use and transfer personally identifiable data from users, members, and visitors (collectively, “you”) of our Mozaik enabled websites, apps, video solutions, including but not limited to those websites located at https://www.mozaikapps.com, and other websites, apps, and services that we operate and from which we directly display or link to this Privacy Notice (collectively the “Service”).

Scope

This Privacy Notice covers only data collected through the Service and not any other data collection or processing, including, without limitation, data collection practices of other web pages to which we link or data that we or our affiliates collect offline or through websites, apps, products, or services that do not display a direct link to this Privacy Notice. Occasionally, we may refer to this Privacy Notice in notices and consent requests related to surveys and special-purpose web pages, for example, our Careers web pages; under such circumstances, this Privacy Notice applies as modified in the particular notice or consent request (e.g., with respect to types of data collected or purposes of collection). Types of Data Collected and How It Is Collected

Information you submit. When you request information, subscribe for a service, register as a user, respond to an online survey, send us an email or other communication, or otherwise actively send us data, we usually collect data such as your name, email, phone number(s), billing address, shipping address, product selections, order numbers, personal interests, and demographic information. In connection with services that require a payment, we may also collect payment information (e.g., credit card number and related verification information). In each such instance, you will know what data we collect through the Service, because you actively submit it.

Information we automatically collect. As part of the standard operation of the Service, we may collect information from your computer or mobile device, including but not limited to your operating system, browser type, IP address, mobile device information, and web request. In addition, we may collect information about how you use our Service, such as the date and time you visit the Service, the areas or pages of the Service that you visit, the amount of time you spend viewing the Service, referring / exit pages and URLs, the number of times you return to the Service and other click-stream data. Our audio verification technology is based on a manual check-in process. Our audio verification technology may use the audio signal from the program. Our technology converts the audio from the program into a sequence of numbers that our servers use to match the program. No actual audio is recorded or transmitted from the app to our servers, and our audio verification technology does not allow us to recreate any audio from the sequence of numbers transmitted to our servers.

Cookies and web beacons. We may use cookies to collect the information described above. A cookie is a small text file that may be stored on the hard drive of your computer or device when you access the Service. We may also use cookies to: (1) provide you with customized content or offers on the Service and other websites; (2) monitor usage of the Service; (3) remember your credentials and to help you navigate the Service; and (4) conduct research to improve our content and services.

We may (with the help of service providers) set or access cookies or web beacons (also referred to as 1×1 pixel.gifs or action tags) on the Service. We may use information from such cookies and web beacons to learn about your visits to the Service and analyze such information to help us understand and improve the Service’s traffic. This information may include: the date and time that you use the Service, the areas or pages of the Service that you visit, the amount of time you spend on the Service, the number of times you use the Service and other usage data, your IP address, and other automatically collected data. Physical Location data. Some mobile phone service providers in the United States are required to operate a system that will pinpoint the physical location of devices that use their service. Depending on the provider and if you are located in the United States, Mozaik may automatically receive this information.

Mobile Device Unique Identifier. Mozaik provides services that allow users to access
and customize Internet content through mobile phones, PDAs and other alternative devices. These devices may collect different information than what is collected by computers. When connecting to the Service using a mobile device that provides Internet access, if the mobile device service provider uniquely identifies the device, Mozaik will collect this information.

Collection Purposes; Use of Data

We may use the data we collect for the following purposes:

To respond to the request that you sent us such as your request for information, request for support, or your request to subscribe to one of our services;
To determine which users have access privileges to certain portions or features of the Service;
To tell you about products or services that we think might interest you;
To provide email alerts that you request;
To provide location based services and location targeted advertising;
To administer, protect and improve our Service and systems;
To better understand the preferences of Service visitors;
To troubleshoot problems with the Service;
To collect aggregated statistics about Service usage;
To personalize your experience of our Service or other websites;
To improve our products and services and for use with our internal business purposes;
To give you information about our technologies, product or service releases, news, and other communications;
Mozaik may use your unique mobile device identification information to offer extended services and/or functionality;
To the extent permitted by applicable law, we may combine the various types of data that we collect, and;
Any other use we describe at the point where we collect the data.

Information About Others

You can submit personally identifiable information about other people to the Service. For example, you might submit a person’s name and email address to send an electronic greeting card or to email a particular feature on the Service and, if you are located in the United States, order a gift on the Service and want it sent directly to the recipient, you might submit the recipient’s name and address. The types of personally identifiable information that may be collected and stored about other people on the Service include: the other person’s name, address, email address and telephone number. We do not share with, rent, transfer or sell personally identifiable information that you submit about other people to any third parties or nonaffiliated entities.

Interactive Features

The Service may provide interactive features (such as forums, message boards, or social media features) that allow you to disclose information directly to other users and the public. Your participation in such features is completely voluntary and at your own discretion and we assume no obligations or responsibility with respect to the information you provide or share through such features. To participate in these interactive features, we may require you to register with us and provide information such as your contact information, name, company name, email address, location, phone number, and desired user name (which may be viewed by other users of the interactive features). We may use the information you provide during registration for analytical and development purposes (such as making product or service enhancements) and to enable you to use the interactive features and to manage your account. You may also personalize our interactive features by voluntarily providing additional information such as your location, instant message contact information, website address, occupation, social networking information, and other information. Our interactive features may also allow you to upload an avatar or other graphical representation of yourself. If you voluntarily provide such additional information, it may also be viewable by other users of the interactive features and/or the public – so please do not provide information that you do not want others to see.

How Long We Keep and Where We Store and Process Data

We keep your personal information for the purposes for which it was originally collected (or to which you have subsequently consented), for other legitimate purposes (such as regulatory compliance and indefinite records retention and legal hold obligations), and as permitted or required by applicable law. We will observe applicable law and take reasonable steps to ensure any person or entity receiving personal information for the purposes described above, are obligated to protect and keep secure the personal information on your behalf. We keep collect, store, and process data in the United States, and we also have servers, contractors and employees around the world in various locations, including, without limitation, Asia and the European Economic Area. If you are located outside of the United States, please be aware that any information you provide to Mozaik will be transferred to the United States. By using the Service and/or providing Mozaik with personally identifiable information, you fully understand and unambiguously consent to this transfer and the collection and processing of information in the United States.

Disclosures of Personal Information

We do not sell or rent your information to telemarketers and do not share your personally identifiable information with others, except as described herein. We also share your information with agents and service providers, such as marketing, analytics, research, credit card processing, providing customer service, fraud protection, etc., who use the data only on our behalf. Certain parts of our Service may offer services or information specific to partners or customers (such as specific services for a certain demographic) and in such cases, we may share your personal information and activities on our Service with those partners or customers for their business use and to provide you with any services or information that you may request.

The Service may be offered in connection with third party partners that help us to provide exciting content and information about products and services (“Partners”). The Service may be branded in conjunction with such Partners, and we will share aggregated usage information with those Partners to bring you the best and most up to date content and information. Any such sharing of information with our Partners will be in aggregated formats and therefore will be shared in a format that is effectively anonymous at a personal level.

Except as otherwise described in this Privacy Notice, we will not disclose personal information to any third party unless required to do so by law, regulation, order or request of any judicial, regulatory, or governmental body, subpoena, or other legal process or if we believe that such action is necessary to (a) conform to the law, comply with legal process served on us or our affiliates, or investigate, prevent, or take action regarding suspected or actual illegal activities; (b) to enforce our Terms of Use, take precautions against liability, to investigate and defend ourselves against any third-party claims or allegations, to assist government enforcement agencies, or to protect the security or integrity of our Service; and (c) to exercise or protect the rights, property, or personal safety of ourselves, our users or others. We may share or transfer your information in connection with a prospective or actual sale, merger, transfer or other reorganization of all or parts of our business. Also, we reserve the right to fully use and disclose any information collected via the Service that is not in personally identifiable form, such as aggregate data.

Access to Your Personal Information

If any personal information that you submitted through the Service is no longer accurate and you wish to update it or you would like us to remove any of your information, please email us at support@mozaikapps.com. We will usually be glad to update, amend, or delete your information for most requests, but we reserve the right to use information obtained previously to verify your identity or take other actions that we believe are appropriate or retain any information as required by law, subpoena, or judicial order.

Security

Transmissions over the Internet can never be completely secure or error-free. However, we take reasonable steps to protect your personal information from loss, misuse, and unauthorized access, disclosure, and alteration. It is your responsibility to keep secret any password and User ID you use to access the Service and to notify us by emailing us at support@mozaikapps.com if you ever have reason to believe or suspect that this password or User ID has been compromised. You are solely responsible for any unauthorized use of the Service conducted via your password and User ID. We are not responsible for the functionality or security measures of any third party.

Children’s Privacy

Protecting the privacy of young children is especially important. For that reason, we do not knowingly collect or solicit personal information from anyone under the age of 13 or knowingly allow such persons to register with the Service. If you are under 13, please do not send any information about yourself to us, including your name, address, telephone number, or email address. No one under age 13 is allowed to provide any personal information to us or on the Service.

Effective Date; Amendments

This Privacy Notice is effective as of May 15, 2012. We reserve the right to change this Privacy Notice from time to time and in our sole discretion. We reserve the right to change, modify, add or remove portions of this Privacy Notice at any time, but will alert you that changes have been made by indicating on the Privacy Notice the date it was last updated. When you visit the Service, you are accepting the current version of this Privacy Notice as posted on the Service at that time. We recommend that users revisit this Privacy Notice on occasion to learn of any changes.
